Kogi guber: Ajaka wins as Supreme Court okays stay of execution

The Supreme Court on Thursday issued a stay of implementation of the Court of Appeal’s rulings dated March 1, 2024, which set aside the petitioners’ inspections before the Kogi State Governorship Election Petitions Tribunal.

The Appeal Court in Abuja previously reversed the ruling of the Kogi State Governorship Election Petitions Tribunal, which was also based in Abuja.

However, the Social Democratic Party (SDP) governorship candidate, Alhaji Muritala Yakubu Ajaka, and the party have asked their legal team to file an appeal with the Supreme Court against the Court of Appeal’s rulings.

The petitioners’ legal team filed an application for an interim stay of execution, and the Supreme Court ruled in their favour.

Moving the motion Thursday morning, Chief J.S. Okutepa, SAN, along with Shaibu Enejoh Aruwa, SAN, and other lawyers, sought the Supreme Court to grant the application in order to avert irreparable harm to the petitioners caused by the Court of Appeal’s rulings.

The Supreme Court agreed and granted the stay in accordance with the reliefs requested in the motion submitted on March 5, 2024.

However, the motion on notice has been postponed until March 11, 2024 for hearing.
