Atiku heads to Supreme Court, files petition seeking to overturn PEPT judgment

The Peoples Democratic Party’s presidential candidate, Alhaji Abubakar Atiku, has petitioned the Supreme Court to overturn the decision of the Presidential Election Petition Court, which upheld Bola Ahmed Tinubu’s declaration as the winner of the 2023 presidential election on September 6.

In his Notice of Appeal, Atiku argued that the tribunal committed grave error and miscarriage of justice in its findings and conclusion in the petition challenging Tinubu’s election as President by the Independent National Electoral Commission, INEC, in the judgment delivered by Justice Haruna Simon Tsammani.

The Notice of Appeal recently submitted by Atiku’s main counsel, Chief Chris Uche, SAN, requests that the Supreme Court set aside the Tribunal’s whole findings and conclusions on the grounds that they did not give the actual image of the grounds of his appeal.

Among other things, the former Vice President claimed that the Tribunal erred in law by failing to nullify the presidential election held on February 25, 2023, on the grounds of non-compliance with the Electoral Act, 2022, when evidence before the tribunal showed that INEC conducted the election on the basis of grave and gross misrepresentation, contrary to the principles of the Electoral Act 2022, and based on the “doctrine of legitimate expectation.”
