Jubilation as Court orders review on Tribunal judgement of LP candidate, Ken Pela

The Labour Party’s candidate for governor, Mr. Ken Pela, filed a complaint against Sheriff Oborevwori, the state’s governor, with the Delta State Governorship Election Petitions Tribunal in Asaba.
The Court of Appeal in Abuja has directed the tribunal to review the complaint.
According to Platinum Times, the appellate court made the judgement on Mr. Pela’s interlocutory appeal against the tribunal’s decision to dismiss his plea on Thursday morning.
The tribunal had dismissed Mr. Pela’s petition in July on the grounds that it was incompetent and blatantly violated clause 18 subsection 1 of the 4th Schedule to the Electoral Act 2022.
In his case EPT/DL/GOV/01/23, Mr. Pela challenges the results of the state’s 2023 governorship election and asks the tribunal for permission to overturn the declaration of Oborevwori as governor of Delta State.
In the petition, the Independent National Electoral Commission (INEC) was named as the first respondent. Governor Oborevwori, his deputy Monday Onyeme, and the Peoples Democratic Party (PDP) are the second and third respondents, respectively.
Mr. Pela appealed the tribunal’s ruling to the Court of Appeal after being dissatisfied with it, among other things to get an order compelling the Tribunal to consider his petitions.
